摘要
中央苏区法制建设是特定历史阶段的产物,其政治基础和法理逻辑是由中国政治(革命)的形势和任务决定的。党运用法制方式领导和推动土地革命、武装斗争和政权建设,重视党内法规制度建设及加强党的自身建设,实现了政治(革命)逻辑和法理逻辑、历史逻辑和实践逻辑的有机统一。坚持党对法制建设的领导是中央苏区法制建设的根本原则,也是法制建设的基本规律。在此基础上,它坚持以政权建设目标为方向、以社会发展需要为基础、以坚持实事求是为原则、以精简灵活高效为方针,在立法执法司法等法制实践中取得丰富成果和伟大成就。
The legal system building in the Central Soviet Area was the product of a specific historical stage,the logical outcome of the situation and task of the Chinese political revolution.By applying legal devices in leading and advancing the Agrarian Revolution,armed struggle,strengthening its political power,the Party attached great importance to improving the framework of Party regulations and enhancing its self-reform,and thus realized the unity in the political(revolution),legal theory,history and practice.It upheld the fundamental principle and law of Party leadership over the legal construction.It set the goal of building the state power as the direction,the needs of social development as the basis,followed the principles of seeking truth from facts,streamlined administration,flexibility and efficiency,and hence made great achievements in the legislation,law enforcement,administration of justice.
