摘要
21世纪初兴起的非遗保护,在学术界讨论、争论中展示了自身的行动逻辑。首先,非遗保护本质上是人类处理自我与他者关系的实践。参与非遗保护的各方都是非遗保护的主体,其彼此间不是主-客对立冲突的关系,而是主-主共生共存的主体间性关系。非遗保护的主体间性是通过订立和履行契约来实现的。传统内生性契约精神曾为维护非遗在特定社区中的传承发挥了重要作用,但在现代社会背景下,自由、平等、互利、诚信的现代外联性契约精神将发挥主要作用。其次,非遗保护是一种文化干预,非遗传承、生产、消费、保护等都是文化干预的表现。文化干预是通过中间人进行的,非遗专家是协调不同非遗干预力量的中间人。最后,非遗契约和干预的实施,必须遵循伦理、法律和科学规则。非遗伦理是建立非遗契约和中间人机制的基本前提,非遗法律是实施非遗契约和中间人机制的基本保障,非遗科学是培养非遗契约精神和中间人的重要方式,它们共同确保了非遗保护的合情、合法与合理。
The intangible cultural heritage protection that emerged in the early 21 st century shows its own action logic in academic discussion and debate.First,the protection of intangible cultural heritage is essentially the practice of human dealing with the relationship with others.The parties involved in the intangible cultural heritage protection are the subject of intangible cultural heritage protection.So there are no subject-object conflict between each other,but rather subject-subject co-existence.The inter-subjectivity of intangible cultural heritage protection is realized through the conclusion and performance of contracts.Traditional spirit of endogenous contract has played an important role in maintaining the inheritance of intangible cultural heritage in specific communities,But the spirit of freedom,equality,mutual benefit and integrity will play a main role.Secondly,the protection of intangible cultural heritage is a kind of cultural intervention,and the inheritance,production,consumption and protection of intangible cultural heritage are all the manifestations of cultural intervention.Cultural intervention is fulfilled through intangible cultural heritage experts as the intermediate people who coordinate different intangible cultural heritage intervention forces.Finally,the implementation of the intangible cultural heritage contract and intervention must follow the ethics,legal and scientific rules.Intangible cultural heritage ethics is the basic premise of establishing the intangible cultural heritage contract and intermediary mechanism.Intangible cultural heritage science is an important way to cultivate the spirit of intangible cultural heritage contract and intermediate people.Together,they ensure the friendship,legality and rationality of intangible cultural heritage protection.
