摘要
儒学是否能再度制度化,是近几十年来学界广泛持续关注的重要话题,而要回答这个问题,我们需要回到历史和事实本身。仁是儒家的核心思想,儒学即仁学,儒学中包含着大量人道主义的内容。据此儒家秉持一系列带有人道主义色彩的法制主张。儒家仁学对中国古代法制产生了积极影响,但是,专制制度以及古代物质技术的落后,使仁学在中国古代法制中并未得到彻底贯彻和执行,中国古代法制仍然充斥着大量野蛮和残酷的记录。在自由、民主和法治的语境里,在现代的物质技术条件下,仁学中的合理因素将拥有更多变为现实的可能性,其是我们实现中国法治现代化,在未来废除死刑、提升司法公信力、防止冤假错案、保障人权、强化司法职业伦理可资凭借的思想资源。因此,在新的历史条件下虽然儒学已不可能再全面建制化,但其仍然是建构中国未来法制的重要思想元素之一,仍具有再度部分制度化的潜力和必要。
Whether Confucianism can be re-institutionalized has been an important topic of widespread and sustained concern in recent decades,and to answer this question we need to go back to history and facts themselves.Benevolence is the core idea of Confucian thought,Confucianism is benevolence,and Confucianism contains large amounts of humanitarian content.Accordingly,Confucian holds a series of legal claims with a humanitarian color.Confucian benevolence had a positive influence on ancient Chinese legal system.H lowever,the autocratic system and the backwardness of ancient material technology have made Confucianism not fully implemented and implemented in the ancient Chinese legal system,and the ancient Chinese legal system was still full of a lot of brutal and cruel records.In the context of freedom,democracy and the rule of law,under the conditions of modern material technology,the reasonable factors in Confucianism will have more possibilities to become reality,it is our modernization of China's rule of law,abolishing the death penalty in the future,promote judicial credibility,prevention of false and wrongful cases,protection of human rights,and strengthening of the ideological resources that judicial professional ethics can rely on.Therefore,under the new historical conditions,although Confucianism can no longer be fully institutionalized,it is still one of the important ideological elements to construct China's future legal system,and it still has the potential and necessity of partial institutionalization.
