摘要
民事执行检察监督立法一直是执行立法中的理论关注热点。民事执行检察监督作为执行程序中不可或缺的监督机制,强制执行立法需要就执行检察监督的条件、范围、审查、方式进行规定。检察监督在民事执行中应当被明确定位为执行救济制度的补充,与法院监督相互协同,因而依申请检察监督以穷尽执行救济为条件、同级检察机关不宜对上级法院执行监督结果直接实施监督。对于监督条件,不能过度限缩依职权监督的范围。调查核实措施作为检察机关审查案件的重要手段,但不应包括调阅案卷,并且在已有严格限制的背景下不必进一步限缩兜底条款的涵摄范围。仅通过柔性监督方式难以保证执行监督实效,需要在执行立法中引入略具刚性的检察监督意见。
Civil enforcement procuratorial supervision legislation has always been a hot spot of theoretical concern in enforcement legislation.As an indispensable supervisory mechanism in the enforcement procedure,the civil enforcement procuratorial supervision needs to be stipulated by the enforcement legislation in terms of the conditions,scope,review and manner of the enforcement procuratorial supervision.Procuratorial supervision should be clearly positioned as a supplement to the relief system in civil enforcement,and should be coordinated with court supervision,so it is not appropriate for the procuratorate at the same level to directly supervise the results of enforcement supervision by the higher court upon application for procuratorial supervision,as a condition of exhausting enforcement remedies.As for conditions of supervision,the scope of ex officio supervision should not be overly restricted.Investigative and verification measures,as an important means of examining cases by the procuratorial authorities,should not include access to case files,and there is no need to further restrict the scope of the catch-all provisions against the background of the strict limitations that have already been put in place.It is difficult to ensure the effectiveness of enforcement supervision through flexible supervision alone,and it is necessary to introduce a slightly more rigid prosecutorial supervisory opinion into the enforcement legislation.
