摘要
个人数据、企业数据与公共数据的区分对于研究我国的数据权益体系非常重要。个人对于个人数据享有的是个人信息权益。基于该权利,个人不仅可以同意处理者处理个人信息,还能够授权他人对其个人数据进行商业化利用。企业数据与公共数据中既有个人数据,也有非个人数据。企业对企业数据享有的是数据财产权。所谓数据资源持有权、数据加工使用权以及数据产品经营权并非是独立的民事权利,它们只是从经济政策角度对企业数据财产权内容的描述与形象化呈现。公共数据的权益归属于何人并不重要,重要的是如何实现共享与开放。处理不同的数据权益关系,遵循的基本原则是作为人格权益的个人信息权益优越于企业数据财产权与公共数据的共享开放。
The distinction between personal data,enterprise data and public data is important for the study of data rights system.Individuals enjoy the rights and interests of personal information in personal data.Based on this right,individuals can not only consent to the processing of personal data by the processor,but also authorize others to make commercial use of their personal data.Enterprise data and public data include both personal and non-personal data.Companies have data property to their data.The so-called right to hold data resources,the right to use data processing and the right to operate data products are not independent civil rights,they are only the description and visualization of the content of enterprise data property rights from the perspective of economic policy.It does not matter to whom the public data rights and interests belong,but how to achieve sharing and openness is what matters.The basic principle followed in dealing with different data rights and interests is that the rights and interests of personal information as personality rights and interests are superior to enterprise data property rights and the sharing and opening of public data.
