摘要
《民法典》已经确立最有利于未成年被监护人原则情况下,应当重视法律内续造,从民法与特别法衔接以及法律条文内在含义的体系解释视角使《民法典》保护未成年人、对未成年人监护履责施加必要监督的含义更加清晰。按照人身监护的功能主义解释立场,探寻接受家庭教育指导与委托照护、临时监护可能具有的监督含义,以分程度的多元化监护监督措施改善单一依赖监护权撤销的功能不足。从未成年人优先价值位阶、法定代理内外部关系、发展性亲子关系等不同侧面完善“为维护被监护人利益”这一不完全法条的解释,以规制财产处分效力间接形成监护监督效果。通过阐释强制报告、家事关系调查和督促、支持起诉的程序机能,进一步释放未成年人监护监督的作用。
In order to effectively implement the legislative purpose of best interests for minors in the Civil Code,it is necessary to clarify the meaning of Civil Code’s protection for minors and supervision the guardianship for minors,from the perspective of cohesion the Civil Code into special law,and the intention of ordinances.According to the functionalist standpoint on personal guardianship,we shall explore the family education guidance and the entrusted care,as well as the possible supervisory implications of temporary guardianship,so as to realize a pattern change from the revocation of single-dependent guardianship to preventive guardianship supervision through diversified guardianship and supervision measures at different levels.Through the supervision of guardianship,we can restate the priority interests of minors,interpret the internal and external relationships of the legal representative and construct parent-child relationships.In doing so,we can improve the interpretation of the incomplete provision of“safeguarding the interests of the ward”from all aspects,which can finally regulate the guardian’s right of disposing property,then indirectly achieving the effectiveness of supervision the guardianship for minors.By explaining the procedural functions of mandatory reporting,family investigation and supervision,and support for complaint,we can further release the function of the supervision of guardianship.
