摘要
当前消防领域单位违法事故频发,单位违法成为消防事故的重要诱因。如何提升消防治理水平、强化单位执法管理、预防单位违法事故成为一项紧迫的时代任务。因此,需要系统梳理单位违法制度的历史渊源、总结单位违法的基本特点,剖析单位违法中存在的问题,进而探寻单位违法的治理之策。适应国家治理现代化的形势需要,消防执法机关应当加强单位违法治理,明确单位违法的构成要件,区分单位违法与个人违法,理顺多元处罚方式的关系,构建消防合规体系。
At present,the illegal accidents of entities in the field of fire protection are frequent,and the illegal activities of entities have become an important inducement of fire accidents.How to implement the entity’s fire responsibility,strengthen the entity’s law enforcement management,and prevent the entity’s illegal accidents has become an urgent task of the times.By sorting out the historical origin of the entity’s illegal system,summarizing the basic laws of the entity’s illegal,and then exploring the governance measures of the entity’s illegal.In order to meet the needs of governance modernization,this paper puts forward countermeasures and suggestion to clarify the elements of entity violations,distinguish between entity violations and employee violations,and rationalize multiple punishments methods and establish a fire compliance system.
