摘要
2020年新冠肺炎疫情防控期间,在线诉讼有效化解了线下审执困难的问题,疫情为在线诉讼提供了扩展适用的契机和舞台。不过,实证研究表明,当前国内在线诉讼发展还存在许多应用方面的问题亟需解决,如软硬件设施配备不全、突破传统的诉讼机理等。未来,可通过构建不同于线下诉讼的在线诉讼机制,将在线诉讼纳入法律援助,建立健全在线诉讼法律规范的适用及其相关体系,保障在线诉讼在疫情过后继续在审判领域发挥作用。除此之外,扩大在线诉讼在全国范围内的适用,也是推进在线诉讼改革的途径之一。
During COVID-19 epidemic prevention and control in 2020,online litigation effectively solved the difficult problem of offline adjudication,and the epidemic provided an opportunity and stage for online litigation to expand its application.However,empirical research shows that there are still many problems to be solved in the application of online litigation in China,such as incomplete hardware and software facilities and breaking through the traditional litigation mechanism.In the future,online litigation can continue to play a role in the trial field after the epidemic by constructing legal principles of online litigation that are different from offline litigation,incorporating online litigation into compulsory legal aid,and establishing and perfecting the application of legal norms and relevant systems for online litigation.In addition,expanding the application of online litigation across the country is also one of the ways to promote the reform of online litigation.
