摘要
转型期冲突治理实践中,政府由干预者角色转换成当事方角色的现象时有发生。其中一种情况就是,由于政府在其中存在或多或少的利益相关性而使政府从干预方转换成当事方。这种情况大多都是在我国某个领域的市场化改革过程中出现的,但由于问题的非结构性以及缺乏有效的制度,导致人们不得不依赖政府,最终把政府当成是冲突当事方。探讨基层政府冲突治理中政府角色的转换问题是关系到政府冲突治理效果的重要课题。尽管学界对这一现象有所关注,但既有研究尚缺乏较实证性的分析。基于此,通过一起典型的物业纠纷事件,本论文回答了在政府具有一定的利益相关性的冲突中,政府是如何从干预者转换成当事方的,什么要素起着关键性的作用等。研究结果表明,政府运用的各种治理机制的有效与否对政府角色转换有重要作用,政府角色转换是通过三个渐进的过程而完成转换的。本文研究结论不仅有助于我们更好地了解和认识非制度化背景下政府在冲突治理中的角色,还有助于实践中公共管理者有意识地制定冲突治理方略并提高公共管理的效率和水平。
The conflict of the government as the third party interventionist refers to the type of conflict which occurs between the market subject and the other subject such as the enterprise,but the government acts as the"third party interventionist"to mediate.The dilemma of such conflict governance is that the public has a high degree of dependence on the government,but a low level of trust makes it difficult to mediate.During the transition period,the scope of such conflicts is very common,bringing great challenges to government and social governance,and it is urgent to pay attention to and study the types of conflicts.In terms of the current research status,the current research is mainly about how to solve this problem.But little attention has been paid to how the role of government is transformed in the process of conflict governance.Based on this,this paper,through a typical property dispute event,focuses on answering how the government role is transformed and which elements play a key role in the conflict of government as a third party interventionist.The research results show that the limitations of the various governance mechanisms used by the government play an important role in the role of government.This study is not only helpful to enrich and expand the western modern conflict resolution theory,but also has important reference value for China’s conflict governance practice.
