摘要
应急征用补偿机制是应急物资保障体系的重要组成部分,在疫情依法防控中不可或缺,现行立法却并未提供与其重要性和特殊性相匹配的制度保障。国家层面立法的原则性导致了地方立法并不具备完整的逻辑链条,在规范征用主体、补偿范围和补偿标准等具体内容时无法为疫情防控实践提供明确、充分的指引,补偿程序方面的制度缺口也亟须补足。通过法经济学分析可以得出,将合法预期保护原则引入后续修法能够提供解决之道。在立法形式上,应通过专门立法完善应急征用补偿制度体系,构建可操作性良好的合法预期利益判断标准;在具体内容上,应通过修法明确补偿的范围和标准,并探索建立以常态下的预征用协议为主、应急状态下的征用决定为辅的征用模式。
As an essential part of the emergency supplies guarantee system,compensation mechanism of emergency expropriation is indispensable to the law-based prevention and control of the epidemic.However,the current legislation does not match the importance and particularity of the system.The principled feature of the legislation at the national level leads to the fact that local legislation does not have a complete logical chain,and consequently fails in providing clear and sufficient guidance for the practice of epidemic prevention and control when regulating the specific content in the aspects of expropriation subject,compensation scope and compensation standards and so on.In addition,the institution gap in compensation procedure also needs to be filled.Through the economic analysis of law,it can be concluded that the problem can be solved by introducing the principle of legitimate expectation protection into the subsequent amendment of the compensation system for emergency expropriation.In the form of legislation,the compensation system for emergency expropriation should be perfected through special legislation,through which the judgment standard of the legitimate expected interests with good operability will be established.In the aspect of specific contents,the scope and standard of compensation should be clarified through revision of the law,and the expropriation mode which is mainly based on the agreement of pre-expropriation under normal conditions and supplemented by the expropriation decision under emergency conditions should be constructed.
