摘要
民法典作为一部保障人民权利的伟大法典,其所规定的民事权利布满全篇。民事权利之设立不仅拥有坚实的政治基础、经济基础和社会基础,而且各分编在总则编的统帅之下对五大民事权利进行系统且细致的规定,各项制度均围绕民事权利而设置,最后以侵权责任编作为权利救济之兜底保障。民法典借鉴潘德克顿立法模式,但充分彰显中国特色和极具创新意识,始终以民事权利作为中轴线贯穿整部法典,通过总分结构构建以民事权利为核心的横向民事权利体系和纵向宝塔式权利框架,为民事主体之权利的合理享有、行使和救济提供坚实的制度支撑。
As a great code to protect people’s rights,the civil rights stipulated in Civil Code cover all aspects of people’s life.The establishment of civil rights not only has a solid political foundation,economic foundation,and social foundation,but also has a systematic and detailed regulation of the five major civil rights under the command of the general provisions.All systems are set around civil rights and finally,the tort liability is taken as the basic guarantee for the right relief.The Civil Code draws lessons from Pandekton’s legislative model,but it fully demonstrates China’s characteristics and has a strong sense of innovation.Civil rights have always been the central axis throughout the code.Through the general and sub structure,the horizontal civil right system and vertical pagoda-typed right framework with civil rights as the core are constructed to provide a solid institutional support for the reasonable enjoyment,exercise and relief of civil rights.
