摘要
劝返作为一种新生的引渡的合法代替措施,在境外追逃中发挥了极大的作用,也对构筑国家治理体系现代化发挥一定的作用。自开展“猎狐2014”以来,中国很多外逃人员已经自愿接受劝返,主动回国接受刑事审判。但由于劝返措施作为一种新生事物,相关法律不完善,劝返的主要内容和劝返性质没有准确的专业界定,尤其是在境外追逃接受劝返行为后主动回国的自首认定方面,法学界颇有争议,难以统一,这给境外追逃工作的开展带来很大阻碍。在引渡难、追逃难的大背景下,要解决劝返所处的困境,促进境外追逃的顺利开展,研究在国家治理体系和治理能力现代化下确定境外追逃接受劝返行为构成自首的标准显得尤为重要。对境外追逃接受劝返行为认定自首问题分析发现,自首相关法律制度存在一些缺失,劝返的适用条件尚不完整和没有明确的条款,境外追逃接受劝返行为认定为自首尚无确定标准。对此,要完善境外追逃接受劝返措施:一是加强反腐败制度建设,有力遏制贪官外逃;二是加强反腐败刑事法治领域的国际合作;三是加快制定境外追逃人员自首认定的法律条款。
Return by persuasion,as a legal alternative to the extradition,has played a great role in overseas pursuits and has also played a certain role in building a national governance system.However,relevant laws of return by persuasion are not perfect,and the main content and nature do not have an accurate professional definition,in particular,there is a legal dispute over the determination of voluntary surrender and return by persuation,which has brought great obstacles to the pursuit of escape abroad.In the context of hard extradition and chasing refugees,it is particularly important to determine the standard to treat return by persuasion as surrender.After analysis of relevant cases,this study found the folloing problems should be solved,deficiencies in the legal system related to voluntary surrender,the applicable conditions for persuasion to return are not complete,and there is no definite standard for accepting return by persuasion as voluntary surrender.This study proposes the following countermeasures:first,strengthen the construction of anti-corruption system;second,strengthen international cooperation in the field of anti-corruption criminal law,the third is to improve the legal provisions for acceptig return by persuasion as surrender.
