摘要
医疗救助作为社会救助中的一项专项制度,是保障我国贫困人口生命健康权的最后一道屏障。国家为确保公民医疗救助权的实现,对提升医疗救助的法制化水平提出了更高的要求。当下,虽然我国社会救助立法从制度建设上对医疗救助独特的制度价值给予了一定回应,但还不足以为医疗制度提供全面的法制保障。现阶段我国学界对于医疗救助制度的研究成果颇为丰富,各学科对于医疗救助制度的研究范围日益拓宽,法学领域的研究也随之呈增长态势,但对于医疗救助制度的法学理论研究仍需强化其研究品格,并对域外经验进行更为深入的法理分析。
Medical assistance,as a special system of social assistance,is the final shield for rights of life and health of the poverty in China.In order to make possible the accomplishment of citizens’rights of life and health,a higher standard for improving the legalization level of medical assistance is put forward.As present,a respond has existed to system value of medical assistance from the perspective of system construction from social assistance legislation of China,but which is not enough to offer a thorough legal protection for the medical system.At current stage,the achievements for the study of medical assistance system from academic community in China.Various disciplines for the study scope of medical assistance system is increasingly expanding and the research in the field of law has been in a rising trend.However,we should pay more attention to study the character of the legal theory of medical assistance system and conduct a deeper jurisprudence analysis to foreign experience.
