摘要
工伤事故发生后劳动者可依三种请求权请求赔偿:工伤保险金请求权、用人单位赔偿责任请求权、商业保险金请求权。在实践中,为了充分发挥工伤保险作用,提高劳动者权益保护力度,应贯彻工伤保险优先赔付、商业保险承担补充责任、用人单位弥补不足的请求权实现顺序。基于赔偿项目的不同特性,与人身具有密切关系的赔偿金应允许劳动者获得多重赔偿,能够实际确定损失的赔偿金则应受损失补偿原则之约束而采取损益原则处理。
The employee can ask for right in compensation for damage by claim for employment injury insurance or claim for employer’s compensation or claim for commercial insurance after work injure accident happened. Practically,claim for employment injury insurance shall be paid in priority,then claim for commercial insurance paid as supplementary liability and claim for employer’s compensation paid to cover the shortage. Such kind of compensation sequence can give full play to the role of employment injury insurance to protect the employee’s rights. In consideration of different features,the employee can claim several compensations related closely with person multiply,and the actual damage shall be confirmed under the principle of offsetting to complete compensation and prohibit enrichment.
