摘要
“人民司法”话语构建贯穿于中国共产党推动法治建设的全部历程,经历了探索起源、曲折发展、改革创新和飞跃发展等四个阶段。在“人民司法”话语构建历程中,形成了一系列宝贵的经验:党的领导是“人民司法”话语的力量之基,人民立场是“人民司法”话语的生命之源,群众路线是“人民司法”话语的实践之径,公平正义是“人民司法”话语的成功之本,守正创新是“人民司法”话语的活力之因。这些经验表明,进一步推进“人民司法”话语的发展,必须坚决同西方司法话语体系作斗争,巩固中国特色社会主义法治话语权;必须不断丰富“人民司法”话语体系的内涵,彰显“人民司法”话语时代性、民族性、科学性;必须坚持“让群众掌握政策”与“尊重人民首创”相统一,让“人民司法”话语生动鲜活;必须坚定不移推动“人民司法”话语改革创新,发挥中国特色社会主义“人民司法”话语优势,夯实法治自信。
The"people’s judicial"discourse construction through the course of the Communist Party of China’s whole process of promoting the rule of law,and it experienced four stages about exploration the origin,tortuous development,reform and innovation,rapid development.In the process of building the"people’s judicial"discourse,it formed such experiences such as the leadership of the party is the base of the"people’s judicial discourse’s"power of words,the people’s position is the source of the"people’s judicial discourse’s"life,the mass line is the path of the"people’s judicial discourse’s"practice,fairness and justice is the soul of the"people’s judicial discourse’s"success and the Integrity and innovation is the reason of the"people’s judicial discourse’s"energy.These experiences show that to further promote the development of the discourse of the"people’s judicature",we must resolutely fight against the western discourse system and consolidate the discourse power of socialist rule of law with Chinese characteristics.It is necessary to enrich the connotation of the discourse system of the"people’s judicature"and highlight the epochal,national and scientific nature of the"people’s judicial"discourse.We must adhere to the unity of"letting the masses control policies"and"respecting the people’s initiative"and make the discourse of"people’s administration of judicature"vivid.We must unswervingly promote the reform and innovation of the"people’s judicature",give full play to the advantages of the socialist"people’s judicial"discourse with Chinese characteristics,and consolidate self-confidence in the rule of law.
