摘要
“重要论述”国际规范扩散实质上是“重要论述”的国际化,具体表现为“国内人权理念——国际人权理念——国际人权规范”的发展进路。“重要论述”国际规范扩散旨在打破国际人权规范发展的中西方角色固化,有助于增强中国对外政策与行为的合法性与感召力。当前,全球人权治理困境凸显西方自由主义理念与规范的能力赤字,人权异化昭示全球人权治理亟需正本清源,而“重要论述”展现了全球人权治理改革的中国智慧。在推进“重要论述”国际规范扩散过程中,中国可借鉴西方自由主义人权话语、和平共处五项原则以及人类命运共同体理念的规范扩展以及儒家文化被写入《世界人权宣言》的历史经验。在此基础上,中国应进一步凝练发展主义人权观以开展国际规范竞争,运用社会框定策略形成“重要论述”国际规范扩散的社会共识,统筹利用国际和区域制度平台,重视“重要论述”中的人权理念从软法走向条约的谋篇布局。
The international norms diffusion of Xi Jinping thought on respecting and protecting human rights is essentially the internationalization of Xi Jinping thought on respecting and protecting human rights.It is manifested in the evolution from domestic human rights concepts to international human rights concepts,then to international human rights norms.The international norms diffusion of Xi Jinping thought on respecting and protecting human rights aims to break the solidification of the Chinese and Western roles in the development of international human rights norms,and helps to enhance the legitimacy and influence of China’s foreign policy.The dilemma of global governance on human rights indicates the capacity deficit of Western liberalism,and the dissimilation of human rights indicates that global governance on human rights urgently needs a radical reform.Xi Jinping thought on respecting and protecting human rights could provide a Chinese approach for the reform of global governance on human rights.To promote the international norms diffusion of Xi Jinping thought on respecting and protecting human rights,China can draw upon the historical experience of the normative diffusion of Western liberal human rights discourse,the Five Principles of Peaceful Coexistence,the concept of a community with a shared future for mankind and the inclusion of Confucianism in the Universal Declaration of Human Rights.On this basis,China shall distill its developmentalist view of human rights in order to compete with western liberalism,use social framing strategies to form a social consensus on the international norms diffusion of Xi Jinping thought on respecting and protecting human rights,make comprehensive use of international and regional institutional platforms,and pay attention to the planning and layout of the human rights concepts in the Xi Jinping thought on respecting and protecting human rights from soft law to treaties.
