摘要
地方法治调控作为一条倒逼全国整体性营商环境优化的独特路径,正在对我国的国家治理体系与治理能力产生深远影响。营商环境优化与地方法治调控具有内生关联:制度与法律的路径分异激活了营商环境优化的法治土壤。而地方法治调控的非规则性与非独立性使地方法治调控在央地关系固化的背景下成为营商环境优化的深层次障碍。对营商环境优化中的地方法治调控行为进行规制,一方面需要加强中央立法和司法权威,另一方面需要尊重地方法治调控的独立并进一步推进地方法治调控的社会化改革。地方法治调控会逐步从边缘推进至中心,成为营商环境优化的新方略和中国法治发展的范式自觉。
As a Chinese mechanism of institutional change,local competition by law constitutes a unique way to force the optimization of the overall business environment of the whole country and is having a profound impact on my country’s national governance system and governance capabilities.The optimization of doing business environment is intrinsically linked to local competition by law:The difference between system and law highlights the soil of rule of law for optimizing doing business environment,and the practical evolution of government competition reflects the realistic vitality of local competition by law.Local competition by law also has a negative impact on the legalization of business environment.To regulate local competition by law in optimization of doing business environment,on the one hand,the central legislative and judicial authority needs to be strengthened through a“top-down”approach;on the other hand,the socialized reform of the competition that respects the independence of the competition and stimulates the vitality of the business environment system through the“bottom-up”approach should be promoted.The competition will gradually move from the edge to the center,and become a new model to optimize the doing business environment and the development of Chinese rule of law.
