摘要
数字技术的普及与应用进一步加剧了长视频许可效率与短视频传播效率之间的矛盾,致使短视频使用人侵犯长视频作品的侵权现象频发。为此,基于私人自治的理念,若欲实质上缓解长短视频之冲突,我国在构建平行授权制度和延伸性管理制度之时,需将数字技术与集体管理制度相结合,构建长短视频版权在线交易系统,以此充分发挥平行授权制度和延伸性管理制度在数字化时代的积极作用,进而最终推动长短视频产业之间实现互惠共赢的价值目标。
The popularization and application of digital technology has further exacerbated the contradiction between the efficiency of long video licensing and the efficiency of short video dissemination,resulting in frequent infringements of short video users infringing on long video works.For this reason,based on the concept of private autonomy,if we want to substantially alleviate the conflict between long and short videos,when building a parallel authorization system and an extended collective licensing system,we need to combine digital technology with collective management systems to build an online trading system for long and short video copyrights.In this way,the positive role of the parallel authorization system and the extended collective licensing system in the digital age can be brought into full play,so as to ultimately promote the value goal of mutual benefit and win-win between the long and short video industries.
