摘要
数字经济相较于传统经济存在更加严重的信息不对称,数据数量、数据质量在竞争中起关键作用、单边免费的双边或者多边市场、强大的用户锁定机制等新的特征,引发了数字平台垄断问题。数字平台的特点,对市场支配地位认定规则构成挑战,引起数字平台竞争相关市场界定困难,市场支配地位的认定标准发生移位,出现了一批非典型滥用市场支配地位行为。结构主义仍然是认定市场支配地位的首选方法,但需增加新的考量因素,其中免费端市场的用户是最重要指标,财务状况和技术能力是收费端的核心指标。数字平台的反垄断,宜遵循规制和谦抑并用的原则,对典型与非典型滥用市场支配地位的行为一并规制,反垄断执法和其他综合性手段相结合。
The digital economy has more serious information asymmetry than the traditional economy,the quantity and quality of data play a key role in the competition,the unilateral free bilateral or multilateral market,the powerful user lock-in mechanism and other new characteristics,have created the problem of digital platform monopoly.The characteristics of digital platforms challenge the rules for determining market dominance,which makes it difficult to define the market related to digital platform competition,shifts the identification standard of market dominance,and emerges a number of atypical abuses of market dominance.Structuralism remains the preferred method of determining market dominance,but new considerations need to be added,with users on the free side being the most important metric and financial position and technical capability being the core metrics on the paid side.In the anti-monopoly of digital platform,it is advisable to follow the principle of combining regulation and modesty,regulate both typical and atypical abuse of dominant market position at the same time,and combine anti-monopoly law enforcement with other comprehensive means.
