摘要
当前我国义务教育阶段严重违规学生客观存在。为维护教育秩序,义务教育阶段学生如实施严重违规行为,可被强制转学。为保障强制转学措施的正确适用,我国应立法构建专门教育指导委员会评估程序,并明确要求决定机关听取学生及其所在学校其他师生的意见。专门学校可通过强化职业技能教育来提升学生及家长对强制转学措施适用的认可度,并通过提起民事侵权诉讼方式来督促学生家长支付义务教育阶段学生在专门学校学习期间的生活费。
There are students who violate discipline seriously in compulsory education schools.In order to maintain educational order,the students who seriously violate discipline in compulsory education schools must be forced to transfer to another school.In order to ensure the correct application of compulsory transfer measures,we must establish the evaluation procedure for specialized education committee.In the same time,the authorities must listen to the opinions of other students and teachers.Through strengthening vocational skill education,the compulsory transfer measures can be recognized by students and their parents.In order to urge parents to pay bills for their children who study in specialized school,specialized school can file a civil lawsuit.
