摘要
赠与行为说和服务对价行为说都无法准确说明直播打赏行为的性质,直播打赏行为的本质是网络文化情感产品的对价。整体财产减少说和实质的个别财产减少说都主张通过规范化理解,将打赏目的纳入到财产损失的判断之中,打赏目的落空属于财产损失,进而成立诈骗罪,但对直播打赏目的应该采取客观标准进行限缩。打赏目的应依据直播类型梯次判断,首先应当判断打赏行为与主播之间是否形成了具体权利义务关系,若构成具体的权利义务关系,打赏目的即为主播承诺事项的实现,否则目的仅为直播产品的获取,此种情形下只有直播产品具有重大瑕疵才能肯定财产损失。直播产品瑕疵的判断标准为直播基础性事实是否发生错误,基础性事实应根据直播类型分别判断,应区分直播认证的事实信息与价值信息,直播认证的价值信息不属于基础性事实,对价值信息的错误认识不成立诈骗罪。
Both the theory of donation behavior and the theory of service consideration behavior cannot accurately explain the nature of live broadcast reward behavior.The essence of live broadcast reward behavior is the consideration of network cultural emotional products.Both the overall property reduction theory and the substantial individual property reduction theory advocate that the reward purpose should be included in the judgment of property loss through standardized understanding.The purpose of reward should be included in the judgement of property loss.The failing reward purpose makes a property loss,and then the crime of fraud is established.However,the objective standard should be adopted to limit the reward purpose of live broadcast.The purpose of reward should be judged according to the type of live broadcast.We should first judge whether there is a specific right and obligation relationship between the reward behavior and the host.If there is a specific right and obligation relationship,the reward purpose is the realization of the host’s commitment.Otherwise,the purpose is only to obtain the live broadcast product.In this case,the property loss can be affirmed only if the live broadcast product has major defects.The judging standard of live broadcast defects is the basic fact correctness,which is judged by the live broadcast type.The fact and value information declared by live broadcast should be distinguished and the value information does not belong to the basic fact.A misunderstanding of value information does not constitute a fraud crime.
