摘要
法律行为概念是法律体系化的一个产物。古典罗马法学家主要致力于解决具体的实践问题,当时仅极少数法学家进行过市民法体系建构的尝试,未发展出抽象的法律行为概念。人文主义法学家受西塞罗的影响,开始发展市民法体系。德意志自然法学家阿尔图修斯利用人文主义学者拉米的方法,并结合亚里士多德的行为理论和人文主义法学家的成果,发展出了一个独特的法体系,法律行为概念在其中基本成型。内特尔布拉特运用“几何方法”,在阿尔图修斯的基础上继续发展市民法体系,进一步发展法律行为理论。法律行为概念最终获得德意志学者的广泛接受。
The concept of juristic act is a product of the systematization of law.Classical Roman jurists mainly devoted themselves to solving concrete practical cases,and only a very few of them made attempts to construct a system of civil law,without developing an abstract concept of juristic act.Humanist jurists,influenced by Cicero,began to develop a system of civil law.Using the approach of the humanist scholar Ramus and combining Aristotle’s theory of conduct and the results of humanist jurists,the German natural jurist Althusius developed a unique system of law in which the concept of juristic act took basic shape.Based on Althusius’efforts,Nettelbladt used the“geometric method”to develop the civil law system and further developed the theory of juristic act.The concept of juristic act finally gained wide acceptance among German scholars.
