摘要
电子数据相较于传统证据,其容易被篡改的特性,导致其真实性和完整性更加难以判定,降低了电子数据在司法实务中的采信率。确保电子数据的真实完整成为电子数据进一步发挥其独立价值的关键环节。区块链技术的不可篡改、自证其真的特性,可有效增强数据的真实性,并提高其可采性。但区块链技术作为一种新型存证技术,其与法律相融合的保障机制尚有完善空间,电子数据区块链存证在其生成、收集、存储、提交和审查过程中面临个人区块链存证使用率低、链上数据存在失真风险、第三方存证平台取证程序不规范等问题。为解决上述问题,进一步提高民事案件中电子数据的司法适用率,在区块链存证基本原理的基础上,分析区块链技术在司法中应用的优势,针对区块链存证中的困境,从案涉当事人、第三方存证平台、法院电子诉讼平台三个主体角度,提出完善建议。
Compared with traditional evidence,electronic data is easier to be tampered with,which makes it difficult to determine the authenticity and integrity,and reduces the acceptance rate of electronic data in judicial practice.Ensuring the authenticity and integrity of electronic data becomes the key link for electronic data to further exert its independent value.Blockchain technology can’t be tampered with and can prove its authenticity,which can effectively enhance the authenticity of data and improve its admissibility.However,there is still room for improvement in the safeguard mechanism for the integration of new technologies and laws.In the process of generating,collecting,storing,submitting and reviewing electronic data of blockchain,there are some problems such as low utilization rate of personal blockchain deposit certificates,risk of data distortion on the chain,nonstandard evidence collection procedures of third-party deposit certificates platform and so on.In order to solve the above problems and further improve the judicial application rate of electronic data,based on the basic principle of electronic data blockchain deposit certificate,this paper analyzes the admissibility advantages of blockchain deposit certificate,and puts forward suggestions for improvement from the perspective of the parties involved in the case,the third-party deposit certificate platform and the court electronic litigation platform,aiming at solving the difficulties existing in the stages of blockchain deposit certificate.
