摘要
中国近代具有现代意义的行政立法始于清末法制改革 ,在其后的 4 0余年间 ,晚清政府、北洋政府、南京国民政府制定和颁布了数以百计的行政法律法规。这些行政法规是中国近代整个法律体系的重要组成部分 ,也是中国传统行政法律迈向现代行政法律的开端。中西法律文化冲突的时代色彩 ,现代法律形式和法律实质的对立和悖离 ,以及突出的阶级性和多变性 ,对中国近代的政治制度和行政管理产生了相当的影响。
The beginning of administrative law in modern China is from legal system reformation in the end of the Qing Dynasty.From early 20 th century to 1940s,the late Qing government,Beiyang government and Nanjing national government enacted hundreds of administrative laws.These administrative laws are important components of law system in modern China.They affected political system and administrative management of modern China.The article studise laws of administrative organization,personnel,supervision and lawsuit so as to analyse characteristics and limitation of modern Chinese administrative laws.
