摘要
本文通过分析实证主义哲学、新康德哲学、存在主义哲学和功能主义社会学理论等各种哲学思潮对古典犯罪论体系、新古典犯罪论体系、目的论体系、新古典目的综合犯罪论体系等刑法犯罪论体系的影响,指出犯罪论体系发展的两条线索:一是犯罪人的主体性从罪责上溯到与构成要件要素之中,一是立法者的目的性从完全忽略上升到归入有责性判断之中。这二条线索,体现了价值论对犯罪论体系中的影响,揭示了刑法规范的主客观相统一因素,即刑法规范是客观犯罪事实和立法者主观目的的综合体现。
