摘要
犯罪目的是指行为人追求和希望自己行为发生危害社会之行为后果的主观意图。因而犯罪目的属于行为人的主观态度,处于犯罪意志层次,但区别于犯罪意志因素。其内容是针对特定行为而追求有危害性的特定后果。因此,犯罪目的在根本上区别于犯罪动机,"意图犯"中的意图也并不是犯罪目的,相反,目的犯中的目的即为犯罪目的。犯罪目的的确定不能单凭刑法典的直接规定,而应根据具体犯罪的实际构成要求进行分析。
