摘要
十月革命和苏联解体两个时间点可以把俄罗斯历史分为三个阶段。就缓刑制度而言,这三个阶段的缓刑制度之间既有所区别,又保持着一定的延续性。即便不同的社会制度(社会主义和资本主义)决定了缓刑制度在本质上的不同,但是仍可以相互借鉴和为自己所用。本文的考察表明了俄罗斯缓刑制度的现实是在反思历史的基础上形成的,是对历史的继承和进一步发展。
The October Revolution and the disintegration of the USSR can separate the Russian history into three parts.As far as probation system,there are differences in these three kinds of probation systems,but there is also continuity among them.Although the difference of Social system determines the intrinsic divergence of probation systems,they can learn from each other and find something useful for themselves.The study of this article shows that the reality of probation system of Russia is based on the rethinking of history.The reality succeeded the history and further developed it.
