摘要
通过对某地组织的一起拍卖堤滩地活动进行法律分析 ,指出所存在的问题。在土地使用权流转所涉及的几种权利中 ,承包经营权是河道堤滩地综合利用的有效形式。对现实中存在的堤滩地垦植现象要依照水法加以严格规范 。
This paper points out the problems in existence through law analysis of public auction of flood-plain organized in some area. Of several rights relevant to alteration of land use lights, contractual management right is a useful form to take general use of flood-plain. It's necessary to regulate flood-plain reclamation phenomenon according to the Water Law, in order to realize the combination of ecological benefits and economic benefits.
