摘要
以治安管理和刑事侦查权为代表的警察权在本质上属于行政权的范畴,因此对警察权的配置一方面必须符合行政权的有效、及时原则,另一方面又必须遵循对行政权的依法控制原则。对警察权的控制方式最典型的是警察权比例原则和司法控制原则。
Police authority, represented by its power of management of public security and criminal investigation, basically falls into the category of executive authority. The disposition of police authority must conform to the principle of timeliness and efficacy as well as to the principle of legal control. The most typical control of police authority is the principle of proportion and the principle of judicial control.
