经济全球化与反垄断法的域外适用 被引量：2

摘要 随着经济全球化步伐的加快 ,全球范围内的限制竞争行为也日趋增多 ,妨碍了贸易与投资自由化进程的推进。由于国际上尚未达成规范来自企业的国际性限制竞争行为的统一的竞争规则。绝大多数国家通过其反垄断法的域外适用加以管制。通过借鉴外国反垄断法的域外适用的有益经验和立足中国现实国情以及面临的国际形势 ,本文提出中国不宜采用“效果主义”原则而应采用对等原则对反垄断法的域外适用作出规定。
