摘要
专利技术的标准化使得技术标准的强势与专利权的优势相结合,其将使知识产权权利人的市场优势倍增。"得标准者得市场",专利技术标准化已成为国际竞争中新的游戏规则,更是西方大国在国际贸易中的战略手段之一。而我国由于缺乏专利标准话语权,在国际贸易中屡屡遭遇"标准之痛"。面对专利技术标准化给我国所带来的困境,我国应形成一种政府、行业协会及企业的新三角应对机制,建立以自主知识产权为基础的标准体系,力争在国际贸易中取得更大的优势。
The standardization of patented technology combines the strength of technical standards and the superiority of patent.It will strengthen the advantage of the owner of intellectual property rights.As the word says 'Standards must be market',the standardization of patented technology has become the new international competition rules of the game,but also one of the strategic means of western countries in international trade.However,because of the lack of standard patent right,our country encountered 'standard of pain'in international trade frequently.Facing the challenge as the standardization of patented technology has brought to China, we should form a new triangular coping mechanisms jointed by government、industry associations and enterprises.Finally,in order to achieve greater international trade advantage,we should establish a standards system basing on the independent intellectual property rights.
