摘要
大学章程是现代大学制度的规范基础,被喻为"大学宪章"。《国家中长期教育改革和发展规划纲要(2010—2020年)》明确提出,要完善现代大学制度,加强章程建设。在这背景下,章程制定与完善成为各级各类大学的一项重要而迫切的工作。但中国大学传统制度模式使得当代中国大学章程生成面临三重根本性困境。由于我国大学设立与大学章程产生时间上的错位,使其面临合法性困境;由于大学章程强制力的软弱,至使其权威性不足;由于大学章程规范内容过于原则和概括,导致其适用性低下。推进中国现代大学制度的构建与完善需要破解大学章程的合法性、权威性和适用性困境。
The university constitution is regarded as the normative foundation of modern system of universities,and is even compared to 'the Charter of University'. Perfecting the modern system of universities and strengthening the construction of university constitution,are put explicitly forward in the Outline of China's National Plan for Medium and Long-term Education Reform and Development(2010-2020). The formulation and perfection of the university constitution,under this circumstance,become a crucial and urgent task for different levels and sorts of universities. Even though,three fundamental dilemmas of the university constitution's generation,owing to the traditional mode of Chinese university system,are to be found. The dilemma of legality of the constitutions is faced,firstly,because the establishment of universities is not usually simultaneous with the formulation of the constitutions. Secondly,the authority of the constitutions is suspicious for the lack of mandatory force. Furthermore,the constitutions are not so applicable by the excessive pursuit of generality and abstraction. The dilemmas of lacking legality,authority and applicability need to be resolved,therefore,at the demand of constructing and perfecting the modern system of university in China.
