摘要
回顾中外历史上关于精神损害赔偿的理论争议及立法与司法的实践演进，对我国现行精神损害赔偿制度的形成及不足之处进行评析，研究了精神损害赔偿的权利人确定标准、赔偿数额的确定原则和计算方法，参考国外立法例。
The author analyses the establishment and defect of present Chinese Compensation system for moral damage.It is suggested that China determine the amount of compensation through the coefficient formula.
