摘要
通过沿着礼的涵义、特征、历史沿革、作用和地位分析思路,从法律性的角度概括"礼"现象的普遍、变动表现,并与法进行相似性比较,证明"礼"具备法律性,并合理解释"礼"与现代法之间存在差异的客观原因。从而以新的视角深化对中国传统法精神的认识,诠释中国传统法的历史与现状,明确我国在促进和谐法治文明、建立现代法治体系过程中,对待传统法继承问题的态度。
The article runs along the analytical thoughts of the Li,from the view of its defines,characters,historic evolution,function and status,then concludes the fluctuant and extensive representation about the Legality of Li, while comparing with the Law to prove the characters of Li are as same as some of the Law.Try to explain the rea- sons which have led to the difference between the modem Law and Li.Anyway,the paper was written to recover the traditional understanding of Chinese Law,show the history and actuality of Chinese Traditional Law,in order to im- prove the positivity in inheriting the tradition in the process of establishing the modem law system and harmonious social nomocracy.
