摘要
韦伯(Max Weber)对我国学术界已不是一个生疏的名字,尽管他的实质性观点之一,即只有基督教新教中所包含的文化基因才有可能发展出并有助于现代资本主义经济(市场经济)的发展,已为二战后一些国家和地区的资本主义市场经济的迅速发展所提问,并为东西方一些学者的著作指出是一个虚假的命题;但抽象的看,其观点仍然具有一定的生命力和启示作用。韦伯提出的实际上是这样一个问题,即市场经济不仅是一个经济模式,而且是一种整体的文化;对市场经济的研究,不能仅仅从经济活动的一些硬要素,诸如生产或交换的规模,所应用的技术,所生产的产品等。
This essay briefly inquires into the legal cultural environment in which China′s socialist market economy is to be developed. Based upon Max Weber′s comparative analysis of modern and premodern market economies, the essay emphasizes that a modern market economy is not a free economy that can be automatically evolved from the desire for profits. Instead, it needs a particular social and legal culture. Then,the article goes on to discuss the incompatibility between China′s social and legal culture and the desired market economic system. Furthermore, the essay analyzes the currently popular proposition that only the market economy is a legally institutionalized economy. As a theoretically flawed proposition, the author suspects, it may misguide China′s present drive for a market economy. The article concludes that legal scholars should pay enduring attention to helping the development of rationality in building China′s market and legal system.
