摘要
加强社会管理创新中法律程序问题的研究,对深入理解和认识社会管理创新具有重大意义。之所以强调法律程序的取向,一方面在于当前受"唯目的思维"影响的社会管理模式的滞后,另一方面在于法律程序是保障社会管理创新过程化、制度化的基石。因此,要充分发挥法律程序在社会管理中应有的作用。当前我国创新社会管理的重点在于完善立法程序,推进程序性立法和现代社会管理法律体系建设;健全行政程序,保障行政权力行使的正当性;完善司法程序,建设公正、高效、权威的司法;完善程序性制裁制度,树立法律程序在社会管理中的权威。
Strengthening the study of legal procedures has a great signiifcance to understand social management deeply. The reasons for emphasizing the legal procedures lie in the lag of social management mode influenced by"only objective thinking" on the one hand and the fact that legal procedures are the foundation of safeguarding the institutionalization of social management innovation on the other hand. Therefore, in order to bring the legal procedures into full play, the main points in social management innovation lie in improving the legislative process, promoting procedural legislation and modern legal system of social management, perfecting administrative procedures to safeguard the legitimacy of the exercise of executive powers, improving the judicial process and building a fair, efifcient and authoritative judicature, improving the procedural sanction system and establishing a legal authority in social management.
