摘要
平政院是民国北京政府时期移植自西方的行政诉讼制度,是中国历史上第一个行政审判机关。近十年来中国学界对平政院的研究已日趋完善,但仍然存在着不足。有必要通过对现有研究成果的分析,尤其是对一些具有代表性的文章的分类考察,反思学界近年来研究平政院的得失,并提出一些思考,为以后相关研究的展开提供借鉴和参考。
Transplanted from the Western administrative litigation system during the period of Beijing authorities,the Republic of China,the Administrative Judgment Institute was the first administrative judicial organ in the Chinese history. The past decade has seen that the Chinese scholars have achieved a lot in the researches about the Administrative Judgment Institute,but it is still insufficient. It is necessary,by means of analyzing the current research results and classifying some of the representative papers,to reflect on the gains and losses of the researches about the Administrative Judgment Institute in recent years,outline some reflections and provide references for relevant researches in the future.
