摘要
经过长期的争论反省,宪法义务的规范命题已得到初步确立,这一过程由澄清宪法义务法律关系的独立性、赋予宪法义务规范权利保障价值、挖掘宪法对法律的约束功能完成。近年来,围绕法律义务的社会议题不断出现,构成观察宪法义务规范的现实视角。法治为研究宪法义务的规范建构提供了视角,它应以完善形式为要点,谋求强势改革与宪法权威之间的平衡。挖掘本土化的宪法解释资源是宪法义务法治化的核心。
After a long argument, the normative theme of the constitutional obligation has been preliminarily ascertained. The process has been completed by clarifying its independent legal relationship, injecting the value of protecting basic rights, mining constitutional constraint function of the law. In recent years, the legal issues caused by obligations appear constantly, and constitute a realistic perspective to observe. The rule of law provides an important angle of view to study the implementation question of the theme. It should focus on the construction of formal rule of law, maintain a balance between the reform and the constitution authority. Mining the local resources of constitutional interpretation is the core of constitutional obligation in the perspective of rule of law.
