摘要
现有民事诉讼证明理论的许多观点都有待商榷。可以民事诉讼证明的本体论为研究对象 ,借助逻辑学和法学的二重知识背景 ,通过分析民事诉讼证明与逻辑学中的论证、与法学中的证明责任、法律推理之间的关系来探究民事诉讼证明的本质。
Many ideas in the theory of the existing civil litigation proof are to be discussed. The noumenon doctrine of civil litigation proof taken as a studying object to study the nature of civil litigation proof with the aid of the two layer knowledge background of both logics and science of law, by analyzing the relationship between civil litigation proof and the argumentation in logics, burden of proof, and legal reasoning in jurisprudence.
