摘要
法学教育天生就具有内在的二重性 ,即职业培训性和学术研究性的二重对立 ,并因此而形成了不同的法学教育理论、目标、模式、内容和方法。本文追溯了中西法学教育的发展史 ,力图厘清二重性在法学教育中的作用及实践性法律教育模式出现和发展的必然性。在这一基础上 ,文章对法学教育的宗旨、模式、内容和方法等问题提出了新的看法。
Ever since its birth,legal education has had its internal dualism,i.e.dual natures of occupational training and academic research,which shape different theories,purposes,models,contents and methodologies of legal education.By telling the history of legal education in both Chinese and the West,the article tries to estimate the impacts of dualism in legal education and the inevitability of occurrence and advent of practically oriented legal educational model.On the basis of this analysis,the article proposes new views on issues of essence,model,content and methodology of legal education.
