摘要
法律保留原则是我国立法法确认的一项重要的立法原则。它要求重大立法事项的设定权专属于最高权力机关制定的法律。军事法作为国家法律体系的组成部分,应当遵循该原则,军事法中违反该原则的规定应及时予以纠正,以维护国家法制的统一。
The principle of law reservation is affirmed as a basic principle on legislation by Legislation Law of our country. It requests that major legislative issues must be regulated by law enacted by the supreme legislature. Military law, as a component part of national jurisprudence, should conform to this principle. The legal provisions in military law which breach this principle should be corrected to maintain the consistence of the nation’s legal system.
