摘要
法律是社会关系的调节器,社会的变迁必然引发法律的变迁。在风险社会中,现代行政法的各个环节,包括立法、执法、司法都处于危机之中。为了有效回应风险社会提出的挑战,现代行政法必须进行转型,具体体现为行政立法和决策的协商民主化、行政执法的反思理性化和行政诉讼范围的扩大化。
Mankind has entered into the risk society. All links of modern administrative law including legislation, execution and judicature are deep in crisis in the risk society. In order to deal with the challenge effectively, the administrative law must make a shift towards democratization of administrative legislation and policy making, reflective rationalization of administrative execution and expansion of administrative litigation range.
