摘要
在现代法治社会中 ,公共利益与个人利益之间始终存在着一定的张力 ,如何在两者的冲突中寻求合理的平衡 ,实现国家、社会与个人共同利益 ,是宪法学研究的重要课题。公共利益价值的合理认定首先应回归到宪法文本 ,从文本的角度提供解释公共利益的价值基础、基本原则与具体规则 ,使公共利益的实现获得宪法基础 。
A Analyse on Public Interest in the Version of Constitution Abstract: There is much contradiction between public interest and personal interest in modern society of rule by law ,it is a important task how to harmonize the contradiction and accomplish the interest of nation ,society and personal .In this thesis , the author stand for that should explain the value basis ,basic principle and concrete rule of public interest from the visual angle of constitution version , in order to supply a basis of constitution for the realization of public interest and avoid understanding wantonly to the conception of Public Interest.
