摘要
许多国家特别是欧美各国对于私立学校的地位、性质、办学方式及其资产归属都较早的予以完善的立法。这在当今世界被看成是衡量一个国家和地区私学发展水平的标志。国家对私立学校的资助通过有关法律法规明确化、条文化,大都采取扶持的政策,实行“公助私学”或“私校公助”。各国对私立学校的管理手段和原则在法律中都有着明确的规定,鼓励私立学校在法律许可范围内自由办学。我国民办学校的立法基础是所有权问题,我国现存相关法律对于民办教育机构所有权的规定比较含混甚至相互抵触。我们应该从我国现实出发,借鉴各国私校依法办学的理论和经验,对国家、社会与民办学校的法律关系作适当的调整。
Many countries especially Occident al countries legislated early about private schools' position ,character,founding way and assets attribution.In today' s world,it is considered that this is a badge to view the level of private schools' education in a country or a district.The countries finance the private sc hools through some laws and regula-tions.Most of the countries adopt financing policy.The countries laws p rescribe clearly about the means of adminis-tration to private schools.Private schools are encouraged to have freed om of founding schools.The key probl em of lawmaking in China is the possession.The prescript in the existing laws a bout it is unclear even conflicting.From this reality,we should borrow the th eoretics and experience from other c ountries,and regulate the relation among country,society and private schools.
