摘要
2000年8月25日通过的新《专利法》增加了对专利权人的许诺销售权的保护。本文从概念、特征、构成要件、法律保护等方面进行了阐述, 并在内容中穿插了与TRUOS协议内容的比较, 指出了许诺销售权在知识产权法中的新突破。
The new “patent law” passed on 25 August 2000,has increased the protection of the right of offering for sale.This text has been explained from such respects as the concept,characteristic,the important document,legal protection,etc,and has woven in the comparison with TRIPS agreement in the content.It has pointed out the new break-through in the law of intellectual property right.
