摘要
对体育法学提出的对体育进行法律或法学定义的必要性进行了论述,提出了体育概念的两个范畴,即作为行业或产业的体育和作为人的行为的体育,分析了体育行为的特征或特性,提出了适合进行法律或法学分析的体育概念,即体育是以既定的客观统一的规则进行的,以竞争为目的的游戏性行为。
In this paper, the significance of defining sports from the viewpoints of law was discussed, two categories of conception of sports, namely sport as industry or occupation and sport as behavior of human being, were brought out. According to analyses into the characters of sports behaviors, the author advanced a conception of sport adapted to analysis into sport from the viewpoints of law, which is that sport is a category of game behavior for competition formatted in pre-fixed and consolidated rules.
