摘要
合议制度是我国法院组织法和三大诉讼法所规定的诉讼法上的基本制度。处理好合议庭的内部关系,使合议庭全体成员真正做到平等地对案件行使审理权和裁判权,从而切实发挥合议制度集体决策的作用,是合议制度的核心问题。处理好合议庭的外部关系,切实保障合议庭独立行使审判权,是合议制度存在并发挥作用的必要保障。
The panel discussion system is the basic litigation system that the organization law and the three litigations prescribe. The crux of the matter is to handle the internal relation of the panel court, make every member justifiably exercise his power over a case in the trial and judgment.
