摘要
有关社会分层原因的功能论和冲突论分析,都旨在研究各阶层中的社会成员对与现存社会分层相应的法律秩序状态的或认同或抵触的不同反应,并从分层结构、阶层意识和分层机制三个角度分析了社会分层与法律秩序的内在理论逻辑。
This paper holds that the analyzes of the theories of function and conflict concerning the causes of the stratification of cociety are all intended to study the agreeing or disagreeing reactions of the members in each social class to the legal order corresponding to the existing stratification of society and analyzes the intrinsic theoretical logic of the stratification society and legal order from the three perspectives of stratification structure,class consciousness and stratification mechanism.
