摘要
作为民法的一项基本原则,意思自治在遗嘱继承中的作用日益凸现。本文在追溯遗嘱自由原则发展演变的基础上,对意思自治原则在遗嘱继承中的体现做了一个全面的介绍,并就完善我国继承法对遗嘱自由原则的设计提出了自己的见解。
As one of the fundmental principles in the civil law field, the autonomy of the will has played a more and more important role in the testate succession along with the development of Chinese legal institution. The article will give you a comprehensive introduction of it in the testate succession on the basis of retroacting for the history of its development, and put forward some personal opinions on how to improve the design of freedom in the Chinese testament system.
