摘要
从我国刑事诉讼证明标准的现状出发,结合两大法系的证明标准理论,探讨了我国刑事诉讼证明标准的改进和完善问题。否定了客观真实说,对法律真实说和排除合理怀疑进行了论证。对有罪判决的证明标准,提出遵循法律真实的证明标准和采用排除合理怀疑的表述的两条思路。
From the present situation of the proving standards of the criminal suit in China, based on the theories on proving standards of the two big genealogies of law, this article explores the improvement and perfection of the proving standards of the criminal suit in China.
